L&E has taken and continues to take preventative measures to guard against the exposure to and spread of COVID-19, including, but not limited to:
Following guidelines issued by the Center for Disease Control (CDC) and local health departments; adhering to social distancing practices; encouraging the use of personal protective equipment (PPE); and increased sanitization of exposed surfaces of the Premises. You acknowledge and understand that given the infectious nature of COVID-19, and in spite of L&E’s preventative efforts, your presence on the Premises, interactions with other persons on the Premises comes with inherent risks. You hereby accept and assume full responsibility for any risks, illnesses, injuries, and/or damages, known or unknown, you might incur while participating in the Activities on the Premises, including, without limitation, risks, illnesses, injuries and/or damages related to: COVID-19 and its associated symptoms; interaction with persons carrying COVID-19 or other communicable diseases; and the availability of medical attention.
You release L&E, and its and their respective agents and waive all rights you may have in law, equity, or otherwise in connection with, any and all claims, demands, causes of action, damages, pain and suffering, obligations, costs, expenses, attorneys’ fees, losses, and liabilities arising out of or related in any way to being exposed to or contracting COVID-19 due to participating in the Activities, or access to or use of the Premises. You agree not to institute any charge, complaint, action, or lawsuit which is based in whole or in part on any matter released by this Release or challenges the validity of this Release or the circumstances surrounding its execution.
